1. General Provisions:

a) All flower arrangements will be made no more than one (1) day before the Event date to ensure freshness and the long lasting quality of the flowers.

b) If flowers are being delivered, a time will be set up for Floral Company to enter all venues on the day of the Event.

c) The Client should contact Gilly's Lilies in case of unexpected circumstances and changes related to the Event, and be aware that there may be additional charges.

2. Alternatives

The flower alternatives (substitutions) are made upon agreement with the Client in the requested price range of the Client (for example, if a specific bloom is unavailable on the Event day).

Upon oral or written agreement with the Client, the Floral Company reserves the right to make substitutions of the flowers which are not of the quality suitable for your Event. Any substitutes will match as closely as possible in color and style as the original flowers agreed upon.

3. Unacceptable substitutions

4. Last minute changes

Unfortunately with last minute changes, Gilly's Lilies cannot guarantee that the same flowers will be available on orders made less than two (2) weeks prior to the Event, but will work diligently on the Gilly's Lilies behalf to match the color and style as closely as possible.

5. Confirmation

A signed “Event Floral Contract” and payment of the deposit are necessary to confirm the stated services from Gilly's Lilies.

 

6. Methods of payment

  1. payments may be made in cash, check, or credit card. A  fee of $25 will be charged for any returned check.

  2. deposit / final payment: Client understands, that a non-refundable deposit of $100 and the signed contract are required to secure the selected Event date.

 

Client understands that if he/she fails to make payment in full as scheduled, the Client acknowledges that the flowers will not be ordered and this agreement is no longer valid and it may be subject to cancellation fees.

 

7. Cancellations

In case the Client decides to cancel the cooperation with Gilly's Lilies, the Client agrees that he/she will submit his/her request for cancellation to the Gilly's Lilies in writing.

Additionally, the Client acknowledges that he/she is requesting custom order floral design work from Gilly's Lilies and understands that, in case he/she cancels the Event, the Client may be subject to cancellation fees and payment in full of outside rentals and custom décor if previously purchased.

Client understands that there are no refunds for cancellations of individual items after final payment is made. Flowers for those items will be utilized to upgrade the arrangements purchased. In the event of cancellation, Client understands that his/her non-refundable deposit will be forfeited, and agrees that he/she may be responsible for cancellation fees based on the following criteria:

(1) For a cancellation made within three (3) weeks or less of the Event date, the Client may be responsible for up to 50% of his/her Floral Company order, plus payment in full of any applicable outside rental fees and miscellaneous décor, in the event the Floral Company has already ordered flowers and custom décor and the order(s) cannot be cancelled.

 

8. Rentals

All vases, containers, liners, arches, lighting, etc. used for your Event belong to Gilly’s Lilies unless stated otherwise on your floral estimate. You are responsible for returning all rented items the week following your Event or the Floral Company will retrieve these items from your event location(s) for a fee.

If you choose to provide your own vases/containers, Gilly's Lilies will need these items less than 7 days prior to the Event. All containers should be delivered.

All rental items must be returned to Gilly's Lilies within Seven (7) days after the Event date. Client understands that he/she may incur an additional fee to offset the full cost of the rented item(s) in the Event he/she fails to return any rentals within the specified (7) days.

 

9. Installation/setup conditions at the Event

Gilly's Lilies is responsible for the installation and organization of all floral arrangement at the Event at the Event location – floral arch, event centrepieces, floral arrangements, etc.

The delivery fees and setup fees for the Event design and décor are paid by the Client (within quote) 

 

10. Additional Charges

Prices are subject to change as floral arrangements change or services are added. Services may be added to this Contract at any time, provided there is reasonable notice depending on the type of service being added and there is sufficient time to complete the service. Once the services have been added to the total, the Balance Due on this Contract will be adjusted accordingly.

 

11. Photographs

Gilly’s Lilies would like to feature photographs of the Event in the gallery of their website, as well as include the photographs in internal Event publications as applicable. Gilly’s Lilies respectfully request written consent of the Client to grant Gilly' Lilies permission to utilize the Event images as Gilly's Lilies work product for promotion and showcase purposes.

 

12. Allergy Release

This advises to Gilly's Lilies  that the Client has no allergy or sensitivity to the flowers provided by the Floral Company and that the Client will not hold Gilly's Lilies responsible to any possible reaction to sensitivities.

 

13. Venue and Location Limitations and Permits

The Client is responsible for acquiring all permits and necessary permission for all locations on which the Floral Company will be performing services. Gilly's Lilies is limited by the rules and guidelines of the location(s) and site management.

 

14. Travel fees

Travel fees be negotiated if the distance is greater than 10 miles. 

The Client is responsible for any parking, valet or toll fees at the Event location.

 

15. Safety

Gilly’s Lilies reserves the right to terminate the services and leave the location of the Event(s) if Gilly’s Lilies experiences inappropriate, threatening, hostile or offensive behaviour from person(s) at the Event(s); or in the event that the safety of the Floral Company is in question.

 

16. Reschedule

If the Client reschedules the Event and Gilly's Lilies has the new date available, all money paid up until that point shall be transferred to the new date and the parties shall revise this Contract accordingly to indicate the new Event date. If Floral Company is unavailable on the new date, it will be treated as a cancellation, discussed below.

 

17. Cancellation

If the Client cancels the Event or Floral Company’s services 30 days up to 90 days before the Event, then the deposit will be forfeited but there will be no additional charges. If the Client cancels the Event or the Floral Company’s services 30 days or less prior to the date of the Event, the deposit and the full amount of service booked will be charged. In case of no show/missed appointments the deposit plus full amount of service will be charged.

 

18. Refunds

Due to the custom nature of the services of Gilly's Lilies, all amount paid for Gilly's Lilies services is non-refundable. Once the services are completed on the Event day, there are no refunds.

 

19. Limitation of Liability

In the unlikely case that Gilly's Lilies fails to provide the services hereunder due to reasons other than those listed in Force Majeure Paragraph herein, Client’s recovery and Floral Company’s liability is limited to the total amount paid from Client to Floral Company under this Agreement and Floral Company will have no further liability to Client, regardless of the total amount of costs or damages claimed by Client.

 

20. Assumption of Risk; Release of Floral Company

Client is responsible for and assumes the risk of injury to Client throughout the event. EXCEPT AS SET FORTH IN “LIMITATION OF LIABILITY” PARAGRAPH, CLIENT, THEIR HEIRS, ASSIGNS AND NEXT OF KIN, AGREE TO FULLY RELEASE FLORAL COMPANY, AND FLORAL COMPANY’S ASSISTANT(S) AND INDEPENDENT CONTRACTORS FROM ANY AND ALL LIABILITY, CLAIMS AND/OR LITIGATION OR OTHER ACTIONS THAT CLIENT MAY HAVE FOR INJURIES, DISABILITY, OR DEATH OR OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO, DIRECT, SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE OR CONSEQUENTIAL DAMAGES, WHETHER ARISING IN TORT, CONTRACT, BREACH OF WARRANTY, EVEN IF CAUSED BY THE NEGLIGENCE OF THE FLORAL COMPANY, FLORAL COMPANY’S ASSISTANT(S) OR INDEPENDENT CONTRACTORS.

 

21. Force Majeure

Gilly's Lilies will not be liable to the Client for any loss resulting from an act of God, natural disaster (including but not limited to fire, earthquake, storm, hurricane, flood, lightning, tornado), an accident of any kind, an act of the public enemy, war, general arrest or restraint of government and people, civil

 

I, the Client, _______________________________, have read and fully understand all the above terms and conditions and pricing stated in this contract. I agree to the terms and conditions of this contract as well as the cancellation policy. I understand that upon submitting this signed contract, the non-refundable deposit is due before appointments can be reserved. The total cost incurred by the Event party is the responsibility of the Client, and I understand that if a member of the Event party fails to pay for a service, I am responsible for the payment and any unpaid balances will be charged to my account.
